Matthew E. Moersfelder


Matthew Moersfelder focuses his practice in the areas of trademark, unfair competition, and copyright law, with an emphasis on protecting and promoting clients’ overall brand. His experience includes helping clients obtain domestic and international trademarks, maintain and protect current trademarks, and assert trademark rights against infringers. Matthew also counsels on a variety of brand-related IP issues, including advertising, maintaining quality control, licensing, and IP acquisition. His practice also includes extensive counseling and management of e-commerce matters, including terms of use and privacy policies for clients’ Web presence, domain name registration and application strategies, cybersquatting, effective online branding, and preventing unauthorized online use.

Complementing Matthew’s counseling work, his practice also includes representing clients in federal and state court, before the Trademark Trial and Appeal Board (TTAB), and in domain name arbitrations.

Matthew’s clients span a broad range of industries, including consumer goods and services, media and entertainment, games and gaming, chemical distribution, fashion and apparel, and travel. His clients have included Recreational Equipment Inc. (REI), Univar, Alaska Airlines Inc., JetBlue Airways, Kymeta Corporation, Trident Seafoods Corporation, Harebrained Holdings Inc., Frank Russell Company, Car-Freshner Corporation, Suncrest USA Inc., and Strategic News Service.

Energy Heating, LLC, et al. v. Heat On-The-Fly, LLC et al.

Successfully invalidated trademark registration on grounds of genericness in Declaratory Judgment action on behalf of Energy Heating LLC and Rocky Mtn. Oil Field Services LLC as part of patent infringement suit involving heating water for hydraulic fracturing operations. (D.N.D. 2018)

Seconded in-house at Starbucks to act as in-house counsel in directly advising marketing and business units on branding related issues. (2017)

Car-Freshner Corporation, et. al. v. Victory-2000 Eood

Successfully brought trademark infringement action against multiple parties for infringement of Car-Freshner’s distinctive tree design trademarks. (D.N. 2016)

Negotiated coexistence after initiating trademark cancellation action against registration for mark SUN CREST based on Suncrest USA Inc. priority. (T.T.A.B. 2016)
