Patrick J. Curran, Jr.

Patrick Curran is a litigator in Davis Wright Tremaine’s communications group. He represents clients in complex litigation in federal and state courts across the country. Patrick advises clients both in and out of the telecommunications industry on a broad range of commercial litigation matters. He has experience representing individuals and corporations in a wide range of civil matters, including professional malpractice, torts, construction and design defects, and employment discrimination. Patrick also has experience litigating antitrust claims and working on regulatory and transactional projects for clients in the communications and health care industries.

Defended corporation involved in above-ground storage tank inspections in lawsuit following catastrophic failure of two-million gallon storage tank filled with liquid fertilizer. (Vir. Ongoing)

Defense of major national broadcasting and cable company

Defending cable operator in putative state class action alleging trespass in relation to the cable operator’s placement of its facilities. (S.C. Ongoing)

Federal Trade Commission investigation

Advising hospital system during response to civil investigative demand by the FTC in connection with proposed merger. (Ongoing)

McCaskill v. Gallaudet University*

Successfully defended university against lawsuit by former Chief Diversity Officer involving claims under the D.C. Human Rights Act for discrimination based on plaintiff’s presumed opposition to same-sex marriage in Maryland. 36 F. Supp. 3d 145 (D.D.C. 2014)

Representation of wireless tower owner

Representing corporation that manages tower assets and wireless infrastructure in the southern United States in litigation against municipality and zoning board of adjustment following denial of a request for a permit to construct a stealth wireless tower. (W.D. Tex., Ongoing)

Defense of putative class action against major national cable company

Represented cable operator in putative state class action involving refunds for alleged cable outages, concluding in granting of operator’s motion to compel arbitration. (N.D. Cal. 2016)

Representation of nonprofit concerning potentially toxic flooring*

Advised major nationwide non-profit charitable organization on potential liability and litigation strategy relating to donations and purchase of medium density fiberboard from nationwide flooring chain, including potential claims against charity due to exposure to formaldehyde and potential claims against flooring chain based on false representations about quality.
