Christiane A. Roussell is a career-long employment attorney and human resources authority who advises and represents companies at every stage of their life cycle, from startups and emerging companies to mature public and private companies. She has experience as outside counsel for employers in various industries and in-house for employers in the technology and entertainment industries. Christiane provides human resources and employment-related counseling and training to employers on a wide variety of issues, including recruiting, hiring, performance management, discipline, transfers, medical-related accommodations, leaves of absence, wage and hour compliance, contingent labor, reductions in force, and workplace violence. She also conducts workplace investigations and audits of workplace policies and procedures.

In her litigation practice, Christiane represents employers in complex and single-plaintiff labor and employment matters, including wage and hour class and collective actions, and litigation of claims of discrimination, harassment, retaliation, wrongful termination, employee raiding, and trade secrets. She has extensive experience in state and federal courts and administrative agencies throughout California, arbitration, private mediation, judicial settlement conferences, and pre-litigation negotiations.

Employee leaves of absences and accommodations

Advises on issues related to employee leaves of absences and accommodations under California and federal law, including FMLA, CFRA, workers’ compensation, pregnancy, ADA/FEHA, and non-medical protected leaves of absences.

Exemption and misclassification issues

Advises on issues related to classification of employees as exempt from overtime and other wage-hour requirements, and on classification of independent contractors versus employees.

Contingent labor planning for employers heavily-reliant on independent contractors

Advises tech companies, startups, and other clients on classification of independent contractors versus employees and long-term planning to accomplish companies' workforce goals.

Employment advice and due diligence for mergers and acquisitions

Advises on due diligence issues related to potential employment-related liabilities and risks, including successor liability, in connection with various corporate transactions, and on employment agreements for continuing employees.

Workplace investigations

Conducts and advises on workplace investigations related to misconduct and policy violations, including harassment and discrimination.

Employee handbooks and other workplace policies

Creates and revises employee handbooks and stand-alone policies for compliance with California and federal law, including policies regarding leaves of absence and other time off, wage-hour issues, and anti-harassment.

Training on investigations, harassment, discrimination, and performance management

Conducts internal workplace investigations training to human resources and legal professionals. Conducts workplace harassment and discrimination training for managers and non-managers. Conducts performance management training for managers and human resources professionals.

California wage and hour class action for large movie theater company*

Represented a large movie theater company in California-wide class action with claims related to meal and rest breaks, wage statements, and final pay.

California wage and hour class actions for large national manufacturer*

Represented large manufacturer in California-wide class actions with claims related to meal and rest breaks, reporting time, split shifts, and final pay, also involving independent contractor and joint employer issues.
