Allison De Tal
Associate
Allison advises clients—including governmental, private and nonprofit entities—regarding employee benefit and tax matters. Her expertise includes ensuring that clients' benefits plans satisfy the applicable legal requirements, and that clients satisfy their Affordable Care Act (ACA) obligations. She also regularly advises employers regarding worker classification issues, and Form W-2 and Form 1099 reporting requirements.
Allison has extensive experience drafting employee benefit plans, including:
- employer-sponsored retirement plans for governmental entities and privately held businesses;
- cafeteria plans; and
- various types of reimbursement plans.
Since the start of the COVID-19 pandemic, which has caused many employees to move out-of-state, Allison has regularly been determining whether out-of-state employees are subject to state income taxes.
In addition to helping her clients to avoid running afoul of the law, Allison has been instrumental in resolving many tax controversies. She has worked on a number of offers in compromise, and resolved multiple ACA penalty related matters. Allison has represented clients before the IRS Office of Appeals, and drafted briefs and motions filed in U.S. District Courts, U.S. Courts of Appeals, and the U.S. Tax Court.
Allison is also deeply committed to pro bono work. For years she volunteered at Inland Empire Latino Lawyers Association, Inc. (IELLA), where she assisted members of the community with matters ranging from landlord-tenant disputes to immigration advice. At Baker McKenzie, Allison was regularly involved in pro bono matters, and served on a team that secured asylum for a South American client. She was one of the few attorneys selected to attend a National Institute for Trial Advocacy (NITA) training course hosted by Baker McKenzie that focused on immigration and pro bono matters.
