Gerald F. George

Gerald George is a seasoned environmental attorney and litigator, with extensive experience in successfully resolving federal and state natural resource damage actions, enforcement actions, and citizen suits. Gerald also advises on regulatory matters involving air, water, waste, and environmental impact review laws. He has over 40 years’ experience in civil lawsuits, including 25 years of handling major environmental litigation throughout the country.

Gerald has represented  corporate and government agency clients in a wide range of litigation involving natural resource damage claims and response cost claims under CERCLA, the Clean Water Act, the Oil Pollution Act, and state counterpart laws. He also worked as a senior lawyer for the U.S. Department of Justice’s Environmental Enforcement Section, managing the Section’s San Francisco field office and serving as lead counsel on several major environmental enforcement actions, including the seminal natural resource damage case, U.S. v. Montrose Chemical. Gerald is also an experienced mediator, having conducted over 100 mediations since entering private practice in 1995.

Portland Harbor NPL site for oil company

Represents a major oil company in the ongoing RI/FS, response cost allocation and natural resource damage assessment at a multi-party sediment site involving a large industrial harbor. (Ongoing)

Cleanup at California mercury sites

Represents a major mining company in connection with state and federal investigations and remediation at mercury mining sites in north-central California (Ongoing)

New Mexico uranium mill site

Represents a major mining company at former uranium mill undergoing reclamation pursuant to NRC, EPA, and state regulation. (Ongoing)

Mercury mining district remediation and TMDL for California county

Represents a large California county government in resolving natural resource damage claims at a county park and in responding to a still-ongoing related TMDL process. (Ongoing)

Mojave Desert reclaimed mine site

Represents major mining company in responding to CERCLA cleanup demands by BLM on property in the Mojave Desert. (Ongoing)

Waste oil recycling NPL site for oil and utility companies

Represented a major oil company and two public utilities in carrying out the remedial investigation at a waste oil recycling site in Oregon, with EPA recommending no further action after completion of the RI. (2015)

Clean Air Act litigation for utility company*

Represented a California utility in successfully defending a Clean Air Act settlement with the U.S. against a challenge by a citizen’s group. (2012)

Major oil spill for investor*

Represented an offshore oil lease investor in obtaining resolution of Clean Water Act penalty claims in connection with a major oil spill in the Gulf of Mexico. (2012)

Upper Midwest Mine NPL site for mining company*

Represented an international mining company in resolution of response costs claims at a $100 million+ site cleanup in South Dakota, obtaining a $4.2 million complete “cash out” settlement. (2012)
