Jaime Drozd Allen

Jaime Drozd Allen’s practice focuses on a variety of complex commercial litigation, with a focus on consumer class actions (with a particular focus on the Telephone Consumer Protection Act and state law counterparts), business disputes (including partnership and post-sale disputes), health care litigation, product liability, and breaches of contract. She has been selected as a “Rising Star” by Thomson Reuters for each year since 2009.

Hetherington v. Omaha Steaks, Inc. and Omaha Steaks Int’l, Inc.

Representing leading food manufacturing, marketing, and distribution company in putative nationwide class action alleging the company placed automated and prerecorded messages to cell phones in violation of the TCPA and state common law. (D. Or. Ongoing)

Telephone Consumer Protection Act Alleged Class Action

Representing medical services provider in putative class action. (E.D. Mich. Ongoing)

Gragg v. Orange Cab Company, Inc. & Ridecharge Inc.

Defended mobile application developer in putative class action alleging the company sent text messages in violation of various consumer protection statutes. Obtained order dismissing TCPA claim on summary judgment. 995 F. Supp. 2d 1189 (W.D. Wash. 2014). Obtained order dismissing Washington Consumer Protection Act claim, 942 F. Supp. 2d 1111 (W.D. Wash. 2013), and Washington Commercial Electronic Mail Act claim, 145 F. Supp. 3d 1046 (W.D. Wash. 2015). Case resolved. (W.D. Wash. 2017)

Nationwide TCPA putative class action for commercial lender

Representing commercial lender in putative nationwide class action, alleging the company placed calls in violation of the TCPA, and putative Washington statewide class action alleging the company placed automated and prerecorded commercial solicitation calls in violation of Washington's Automatic Dialing and Announcing Device Act, and Consumer Protection Act. Settled favorably on class basis. (W.D. Wash. 2016)

Daymon Worldwide. Inc. v. Lieb et. al.

Represented shareholders of LLC in post-sale dispute that was resolved in early mediation. (W.D. Wash. 2015)

CBS Corp. v. City of Tacoma*

Obtained preliminary injunction against the release of public records falling under the Uniform Trade Secrets Act. (2014)

City of Buckley – Natural Gas Line advice*

Represented municipality in pre-litigation dispute with City of Enumclaw regarding natural gas line agreement and sale of system. (2014)

ETC Real Estate Investment, Inc. v. City of Gig Harbor*

Successfully settled suit brought alleging inverse condemnation stemming from sale of old City Hall property. (2014)

Gillen v. G&Z, LLC et. al.*

Obtained summary judgment dismissing two limited liability corporations from action by non-members of the LLC alleging corporate misfeasance. (2014)

Sherman v. Teva Pharmaceuticals USA, Inc. et. al.*

Represented generic pharmaceutical manufacturer and national retail pharmacy in putative class action alleging damages from the use of drug. (2014)

Swinomish Indian Tribal Community et. al. v. City of Oak Harbor*

Successfully resolved putative class action against the City of Oak Harbor and its contractors for allegations stemming from municipal road construction project (rebuilding roadway and downtown shopping area revitalization). Issues included municipal construction project, potential cross-claims against project manager, general contractor, and sub-contractors, issues of indemnity and subrogation amongst contractors, and allegations of violations of the Indian Graves Reclamation Act. Represented The Polyclinic in action for declaratory relief for the improper interpretation of Department of Health regulations and improper rulemaking regarding its ambulatory surgery center. (2014)

Travelers Insurance Co. v. KBA, Inc.*

Represented the City of Oak Harbor in insurance coverage dispute to retain coverage for putative class action stemming from construction project involving project manager, general contractor, and sub-contractor; issues included potential cross-claims for indemnity and subrogation to and from various contractors and sub-contractors; successfully settled underlying suit with significant contribution from insurer. Represented Highline Medical Center in defense of a determination of non-reviewability from the Department of Health regarding its affiliation with Franciscan Health Services and the relocation of its Level II rehabilitation services from its specialty campus to its main campus. (2013)

Gillum v. State of Washington*

Obtained seven-figure settlement for wrongful death due, in part, to negligent supervision by the Department of Corrections. (2013)

In re the Estate of Robert Kessler*

Successfully removed the surviving spouse of deceased as personal representative. (2013)

Washington State Department of Health v. Swedish Health Services*

Represented intervenor, Overlake Hospital Medical Center, in successfully upholding administrative ruling denying a Certificate of Need for elective percutaneous coronary intervention (PCI) services at Issaquah hospital.  (King. Co. Super. Ct. 2013); appeal pending.

Cervantes v. T16 Management et. al.*

Granted motion to dismiss in adversary proceedings representing liquidating agent of a bankruptcy matter. (2012)

Rosser v. Vashon/Maury Island Park Department*

Obtained summary dismissal of claims in land dispute; upheld on appeal by the Washington Court of Appeals. (2012)

Represented municipality in defense of claims stemming from water purification plant. (2012)

Filosa v. Scottsdale Insurance Co.*

Obtained dismissal of $9 million plus insurance bad faith claim arising from flesh eating bacteria claim related to tongue piercing. Dismissal affirmed on Appeal by the 9th Circuit. (2011)
