Jordan Clark concentrates his practice on complex commercial litigation with an emphasis on consumer protection class action defense, intellectual property, health care litigation, trade secret disputes, and contract disputes. Before joining the firm, Jordan was an extern for a U.S. District Court judge and was a paralegal for the U.S. Department of Justice prior to attending law school.

Defended GNC in putative consumer class action alleging breach of contract and violations of California consumer protection statutes. Obtained order dismissing all claims. (2017)

Register v. GNC Holdings, Inc.

Defended GNC in putative consumer class action alleging breach of contract and violations of the New Jersey Consumer Fraud Act. Obtained order transferring the case after which plaintiff voluntarily dismissed. (2017)

Bauman v. V Theater Group et al.

Defending leading independent Las Vegas theater and entertainment production companies in putative class action alleging the companies sent text messages in violation of the TCPA and the Nevada Deceptive Trade Practices Act. (D. Nev. Ongoing)

Mertlich v. AllClear ID

Defended identity protection company in putative class action alleging violations of the Washington Consumer Protection Act. Obtained voluntary dismissal.  

Gragg v. Orange Cab Company, Inc. & Ridecharge Inc.

Defended mobile application developer in putative class action alleging the company sent text messages in violation of various consumer protection statutes. Obtained order dismissing TCPA claim on summary judgment. 995 F. Supp. 2d 1189 (W.D. Wash. 2014). Obtained order dismissing Washington Consumer Protection Act claim, 942 F. Supp. 2d 1111 (W.D. Wash. 2013), and Washington Commercial Electronic Mail Act claim, 145 F. Supp. 3d 1046 (W.D. Wash. 2015). Case resolved. (W.D. Wash. 2017)

Microsoft anti-piracy litigation

Representing Microsoft in multiforum copyright, trademark, and consumer protection enforcement actions filed against distributors of counterfeit and otherwise illegally acquired software and software components. (Ongoing)

Amazon anti-counterfeiting litigation

Representing Amazon.com in multiforum consumer protection enforcement actions filed against distributors of counterfeit products. (Ongoing)

Other Representative Experience

Access the USA v. Citigroup

Representing financial institutions that underwrote SR-520 bridge construction bonds in a lawsuit by an attempted purchaser alleging state securities act violations, unlawful discrimination, and consumer protection act claims. Removed to federal court and successfully obtained dismissal of federal discrimination claim. 2014 WL 5421250 (W.D. Wash. 2014). On remand, obtained dismissal with prejudice of securities act and consumer protection claims, and summary judgment on remaining claims. (King Cnty. (Wash.) Super. Ct. 2016). Appeal pending. (Ongoing)

Orthopedic Specialty Clinic v. Providence Health & Services

Defended leading nonprofit health system in lawsuit alleging various antitrust and tort claims arising from its hiring of orthopedic surgeons formerly employed by plaintiff. (Spokane Cnty. (Wash.) Super. Ct. 2016)
