Robert D. Newell


Bob Newell does complex commercial litigation. His litigation experience includes securities, trade secrets, noncompete and unfair competition, Uniform Commercial Code, health care, and software disputes in state and federal courts. Bob has extensive trial experience and knowledge in Oregon and federal procedure, and speaks and writes on a variety of litigation topics before lawyers and industry groups.

Representative Experience

Synectic Ventures I, LLC v. EVI Corporation

Represented startup company Endo Vascular Instruments, Inc. (EVI) in a "bet the company" case. DWT joined the case at the last minute to prepare the matter for trial. By taking a very narrow approach to the case, DWT was able to prevail on summary judgment, thus extricating the client from a much larger series of cases, which defendants lost. Plaintiff appealed the judgment and we prevailed in the Court of Appeals.

Greenwood Products, Inc. v. Greenwood Forest Products, Inc.

Represented client in a suit against Greenwood Forest Products and two of its former owners and officers. Litigated case through trial and obtained positive result for client. Assisted team who obtained affirmance in the Oregon Supreme Court of trial court ruling denying directed verdict motions in a complex commercial dispute, reversing the Court of Appeals decision, 351 Or. 604, 273 P.3d 116 (Or. 2012), and who obtained second affirmance in the Oregon Supreme Court of the trial court ruling denying a motion for new trial, again reversing the Court of Appeals decision following prior remand. 357 Or. 665, --- P.3d --- (2015)

Too Marker v. Shinhan USA

Represented defendant on a claim of infringement of a registered trade dress involving a functionality defense. (D. Or.)

Root v. Root

Represented plaintiff in a breach of trust and breach of fiduciary duty against a trustee. (Deschutes Cnty. Cir. Ct.)

Kaiser Foundation Health Plan v. Alta Bates Hospital

Represented plaintiff against hospital in a claim for breach of contract involving a complicated service provision contract. (Arbitration)

Anesthesiologists Associated Inc. v. ProDX

Represented plaintiff medical billing company against software developer for breach of contract and negligence. Jury verdict for plaintiff. (Multnomah Cnty. (Or.) Cir. Ct. 2006)

Black v. Arizala

Obtained judgment in favor of defendant issuer against securities fraud claim arising out of FCC auction of licenses to mobile telephone company in Puerto Rico. Resulted in judgment for our client. (Multnomah Cnty. (Or.) 2005)

Viacom v. Hollywood Entertainment

Represented plaintiff in a multimillion-dollar misappropriation of trade secrets and unfair competition case. (D. Or.)

FTC v. Whole Foods

Represented third party competitor against disclosure of trade secrets. (D.D.C.)

Oregon Health & Science University v. Vertex Pharmaceuticals

Represented plaintiff in a lawsuit against a drug manufacturer in a claim of breach of contract and various patent related issues. (D. Or.) 2003
