Rachel Herd

Rachel Herd has experience in appellate litigation with an emphasis on criminal law and intellectual property. She worked as a law clerk for an appellate judge in the 10th Circuit Court of Appeals.

Representative Experience

Defense of whistleblower claims

Obtained a complete defense verdict after a seven-day jury trial on claims made by a company’s former chief legal officer alleging retaliation in violation of the whistleblower protection provisions of the Sarbanes-Oxley and Dodd-Frank Acts. (W.D. Wash. 2017, 9th Cir. Ongoing)

Carrington et al. v. City of Tacoma

Represented operator of a FERC-licensed hydroelectric project in action brought by dozens of landowners alleging state-law claims for property damage. Obtained dismissal of all claims with prejudice based on Federal Power Act Preemption. --- F.Supp.3d ---- 2017 WL 1426211 (W.D. Wash. 2017)
