Kimberly Bousquet is an experienced litigator and trusted legal counselor. In her nearly 20-year litigation practice, Kimberly has handled everything from simple breach of contract cases to highly complex multi-district litigation, class action defense, products liability, and false advertising/Lanham Act cases. She practices in both federal and state courts, before regulatory bodies, in arbitrations, and in the National Advertising Division (NAD). She is based in the firm's Chicago office but regularly collaborates with DWT attorneys in Los Angeles, Portland, Seattle, New York, and Washington, D.C., on litigation matters and client advice.
Kimberly's recent litigation work has involved defense of allegedly false and misleading product label claims and advertisements, herbicide drift and crop damage claims, foodborne illnesses, breach of contract, trademark infringement, and other issues. Kimberly is also highly experienced in complex e-discovery matters. She has been on the cutting edge of e-discovery throughout her career and most recently oversaw all aspects of e-discovery in a complex multi-district litigation that lasted several years.
Outside of her litigation work, Kimberly maintains a strong regulatory advice practice. She advises food and beverage industry clients on FDA, USDA, state, and local regulatory compliance as well as all matters relating to the Federal Food, Drug, and Cosmetic Act, the Food Safety Modernization Act, the Federal Trade Commission Act as it relates to advertising, and other laws and pending legislation impacting the industry. She has represented some of the industry's largest companies across a broad spectrum – from food producers and agribusinesses to restaurant groups, supplement manufacturers, pet food makers, biotechnology corporations, and biofuel companies.
Kimberly brings a unique perspective to advising her food and beverage clients. Her degrees in biology and environmental studies supplement her advanced legal education in food and agriculture law. Her deep knowledge of the life and earth sciences adds a layer of unmatched expertise to her practice.
