Davis Wright Tremaine attorneys Carol Bernick and Francie Cushman hosted a wage and hour law tune-up! They covered common traps, and offered practical solutions, in this volatile and liability-filled area for employers, including:

  • Classification issues. Is your middle manager exempt? Is the IT person entitled to overtime pay? Should the human resources representative be paid time and a half for hours worked over 40?
  • Hours worked. How should you manage non-exempt employee meal periods if they choose to sit at their desks during lunch? Should an exempt employee who takes his/her Blackberry on an otherwise unpaid vacation be compensated?
  • Regular rate of pay. Should bonuses be included when calculating overtime compensation due? What about travel expenses? Shift differential premiums?
  • Paychecks and final paychecks. What is the best practice when an employee claims an error in his/her paycheck? When should incentive payments or bonuses be included in final paychecks? How should you deliver the final paycheck to comply with Oregon law?

This program was designed for human resources professionals and in-house counsel responsible for employment-related matters.
