In this presentation DWT partner Dayna Nicholson and DWT associate Miriam Swedlow provided an overview of the various federal and state laws regarding hospital quality improvement and medical staff peer review and credentialing as well as the standards imposed by accreditation organizations. They discussed the different federal and state agencies that oversee adherence to hospital quality, improvement and peer review activities and the implications of failure. In addition, they explained the evidentiary privileges afforded by certain activities and provide examples of risk scenarios and best practices for complying with the law and protecting privilege.
