Elizabeth P. Hodes


Elizabeth (Liz) Hodes is an experienced litigator who focuses largely on labor and employment matters. She counsels employers on how to prevent workplace disputes and comply with laws governing hiring and terminations, leaves of absence, payment of wages and overtime, personnel policies, and a wide array of other employment issues. She also helps employers protect their business and goodwill by enforcing noncompete agreements and defending breach of contract, harassment, discrimination, wrongful discharge, and other employment-related claims. For her corporate clients, Liz litigates disputes related to corporate governance, contracts, unfair trade practices, and other issues.

As an experienced litigator, she represents clients in agency proceedings, arbitrations, state and federal court, and before the Alaska Supreme Court. With a sharp focus on developing cost-effective strategies for resolving disputes early and efficiently, Liz has won favorable pre-trial settlements on behalf of many clients. Her clients include Providence Health & Services, Bristol Bay Area Health Corporation, Norton Sound Health Corporation, Citibank, Midland Funding LLC, as well as other health care entities, financial services companies, hotels, broadcast companies, utility providers, and a variety of small businesses.

Representative Experience

Bernard v. Alaska Airlines

Wrongful termination lawsuit filed against Alaska Airlines with multiple other claims alleged. Successfully defended against all claims, securing summary judgment dismissing all claims with prejudice. (2017)

Shearer v. Brooks Range Petroleum Corporation

Currently before the Alaska Supreme Court on interlocutory appeal regarding venue. Defending employment claims by former drilling manager. (Ongoing)

Debenham v. Alaska Urological Institute

Defended and successfully resolved physician tort and contract claims, including wrongful termination, breach of contract, breach of the covenant of good faith and fair dealing, and others. (2016)

Kelly v. City of Cordova, dba Cordova Community Medical Center (CCMC) and Providence Health & Services Washington (Providence)

Successfully defended Providence and resolved claims by former chief financial officer of CCMC regarding wrongful discharge, retaliation, violation of the Alaska Whistleblower Act, intentional inflection of emotional distress, and punitive damages. (2015)

Stewart v. Midland Funding/Hudson v. Citibank

Defending Midland Funding and Citibank in consolidated unfair trade practices lawsuits where plaintiffs seek to avoid arbitration agreement requiring them to proceed on an individual, non-class, non-representative basis. In 2016, Alaska Supreme Court upheld defendant’s motion to compel arbitration and stay proceedings in Alaska Superior Court. (Ongoing)

Dunham, et al. v. Lithia Motors Support Services, Inc.

Successfully defended Lithia Motors in multi-plaintiff wage and hour dispute filed by service managers and service advisors alleging a right to overtime wages. Won before Alaska Superior Court and then Alaska Supreme Court to uphold an arbitration award which found plaintiffs were properly classified as exempt. (2014)

Beach v. Iliuliuk Family & Health Services Inc.

Won summary judgment on all claims in wrongful discharge lawsuit by former employee alleging retaliation and breach of the covenant of good faith and fair dealing. Successfully defended summary judgment ruling on appeal before the Alaska Supreme Court. Superior Court No. 3UN-10-00054 CI (2013)

Workplace investigations

Frequently conducts workplace investigations and provides advice and assistance to timely resolve workplace disputes without litigation. (Ongoing)

Chugach Alaska Corporation v. Henrichs

Represented Chugach Alaska Corp. in successful pursuit of claims for breach of fiduciary duty against former chairman, including a jury trial and defending appeal to Alaska Supreme Court, resulting in a monetary recovery and a ban on service as director for five years. Superior Court Case No. 3AN-05-10182; Supreme Court Case No. S-13094. (2011)

Employment arbitration for health care provider

Successfully defended arbitration defending against constructive discharge and related employment claims and associated efforts to invalidate noncompete agreement. (2011)

Employment litigation for major finance investment firm

Successfully defended a major finance investment firm against claims of discrimination/wrongful termination asserted by a former financial adviser, developing and implementing a cost effective defense strategy using a motion for summary judgment to force a favorable mediated settlement. (2010)
