Nancy Libin

Co-chair, Privacy & Security + Technology group
Nancy Libin, co-chair of DWT’s Privacy & Security + Technology practice, advises clients on legal and regulatory matters related to data privacy and cybersecurity. As a former chief privacy and civil liberties officer of the U.S. Department of Justice, she counsels clients across a variety of industries on compliance with federal laws and state laws, as well as the EU's General Data Protection Regulation.

Nancy also advocates for her clients in proceedings before government agencies and assists companies that face government investigations and enforcement. She advises companies on cybersecurity risk management both by developing incident response policies as well as assisting clients as they respond to and recover from security incidents.

Representative Experience

Advocated before Federal Communications Commission in privacy rulemaking proceedings*

Represented trade association for telecommunications carriers and cable companies before FCC in broadband privacy and other privacy-related rulemaking proceedings. Drafted comments and petitions for reconsideration and counseled client regarding compliance with proposed rules. (2015-2017)

Advised online video content provider regarding app development*

Counseled online video content provider regarding compliance with Video Privacy Protection Act and the Children’s Online Privacy Protection Act in context of developing and deploying new mobile apps. (2017-2018)

Advising companies regarding privacy legislation*

Counsel clients regarding policy and strategy related to drafting and development of federal and state privacy legislation. (Ongoing)

Developing EU GDPR compliance programs for variety of clients*

Working with clients to develop and implement privacy programs to comply with EU data protection laws, including the General Data Protection Regulation. Clients include equipment manufacturers, health care companies, online gaming and entertainment companies, FinTech providers, and consumer products companies. (Ongoing)
