Ashley L. (Watkins) Vulin

Ashley Vulin concentrates her practice in food and beverage matters, including complex litigation and regulatory issues. Ashley has represented clients before both state and federal courts and agencies, on matters ranging from beverage distribution to commodities pricing regulations. She has experience in a broad range of legal issues within this area, including food safety, white collar crime, class action defense claims, and contract disputes.

Ashley’s previous experience includes working as an intern in the U.S. Attorney’s Office in Montana, as well as working as an extern for a North Carolina Supreme Court justice.

Federal Milk Marketing Order

Represented Dairy Institute of California in the promulgation of a California Milk Marketing Order, culminating in a two-month trial-like administrative rulemaking, where we prevailed on all important issues. As part of this process, USDA adopted a regulation virtually identical to the regulation we recommended. (U.S. Dept. of Ag. 2018)

Trial counsel for restaurant chain involved in E. coli outbreak litigation in Nebraska and Kansas. (Ongoing)

Carlin, et al. v. DairyAmerica, Inc. et al.

Representing DairyAmerica in class action alleging damages from alleged improper reporting of product prices to the United States Department of Agriculture. (E.D. Cal. Ongoing)

Regulatory promotion program management

Consultant to national beverage company, focusing on the development and regulatory approval of promotion programs for assorted consumer products. (Ongoing)

RM Beverage Delaware, LLC v. Forbidden Fruit Ciderhouse, LLC

Represented beverage distribution company in distribution agreement dispute with cider manufacturer. Obtained favorable settlement after the start of trial. (Multn. Cty Cir. Ct. 2016)

Agricultural goods contract breach

Represented distributor in Perishable Agricultural Commodities Act (PACA) proceeding against purchaser who breached sales agreements. Obtained favorable settlement. (U.S. Dept. of Ag., 2015)

Consumer v. Restaurant

Defended restaurant in food safety case. Obtained favorable decision and full dismissal of claims in arbitration. (Multn. Cty. Cir. Ct. 2015)

Food contamination lawsuit

Represented organic snacks manufacturer against supplier in lawsuit involving contaminated ingredients from supplier. Obtained favorable settlement. (Multn. Cty. Sup. Ct. 2014)

Canadian distribution contract dispute

Represented a Canadian beer distributor in a breach of contract dispute with a former supplier. Obtained favorable settlement prior to mediation. (2013)

Spirits distributor contract dispute

Represented an alcohol beverage company and alcohol beverage distributor for a distribution contract dispute under Washington law. Obtained favorable settlement prior to arbitration. (AAA Arbitration 2013)

Canadian distribution agreement

Prepared Canadian Distribution Agreement for domestic craft brewer to expand into Canada. (2013)

Commercial Litigation

Blue Box Group, Inc. v. Digital Fortress, Inc.

Represented colocation facility owner in contract dispute with customer, focusing on customer’s early termination of colocation hosting agreement. Following discovery, the case settled satisfactorily. (King Cty. Sup. Ct. 2014)

Gragg v. Orange Cab Company, Inc. & Ridecharge Inc.

Defended mobile application developer in putative class action alleging the company sent text messages in violation of various consumer protection statutes. Obtained order dismissing TCPA claim on summary judgment. 995 F. Supp. 2d 1189 (W.D. Wash. 2014). Obtained order dismissing Washington Consumer Protection Act claim, 942 F. Supp. 2d 1111 (W.D. Wash. 2013), and Washington Commercial Electronic Mail Act claim, 145 F. Supp. 3d 1046 (W.D. Wash. 2015). Case resolved. (W.D. Wash. 2017)
