Derek Bishop defends employers in wage-and-hour class and collective actions and other high-stakes workplace disputes and counsels clients on the employment issues that shape their daily operations. He represents companies across industries including agriculture, transportation, manufacturing, and technology, with experience before the Equal Employment Opportunity Commission (EEOC), the National Labor Relations Board (NLRB), and state and federal courts in Washington and Oregon.
Derek routinely handles complex employment litigation, with a particular focus on class actions involving state and federal anti-discrimination laws, wage-and-hour statutes, meal and rest break requirements, compensation and scheduling practices, and Washington state's restrictions on noncompetition covenants. He also defends employers in a broad range of single-plaintiff matters, including discrimination, retaliation, and statutory claims pertaining to paid leave and improper confidentiality provisions.
In addition to litigation, Derek helps employers navigate compliance obligations involving discipline, compensation, scheduling, and other workplace practices. His wage-and-hour experience is informed by his writing on Fair Labor Standards Act (FLSA) collective action notice standards, and he drafts and negotiates employment-related agreements, including employment contracts, confidentiality agreements, severance agreements, and payroll plans.
