With a background in engineering and industry, Larry Burke supports his clients through an interdisciplinary approach to his environmental, health and safety practice. Over the course of a legal career spanning three decades, Larry has observed that the issues facing his clients rarely fit neatly into legal, business, and technical classifications, and are most effectively approached with a little prudent creativity.

Larry's work encompasses a range of issues, including those relevant to consumer products, groundwater contamination, and toxic exposures. Larry assists facilities in hazardous and universal waste management, air permitting, environmental auditing, asbestos, Superfund issues, and OSHA compliance. He represents clients in litigation involving citizen suits, RCRA, CERCLA, the Clean Air Act, the Clean Water Act, and California's Proposition 65. Larry also provides advice on insurance coverage and representation in insurance coverage disputes.

Practice Highlights

Air

Helped make the world safe for the cloud by defending a data center's air permit from a permitting challenge and appeal.

Redeveloping contaminated properties

Obtained liability protections for parties wanting to buy contaminated sites but not wanting uncertain exposure to environmental claims.

Defense of enforcement actions

Assisted in negotiating settlement with State and Federal regulatory agencies where a client's employees had taken upon themselves to shut off a pollution control device.

Auditing

Organized and managed Environmental Health & Safety audit for Northwest hospital chain (2016) and assisted with nationwide auditing of Fortune 500 company with operations in 37 states. (2015-2017)

Brownfields

Assisted the City of Salem, Ore., in obtaining prospective purchaser agreements for various locations at Minto Island and a former mill property to allow redevelopment. (2013-2015)

Washington County v. Estate of Saleen et al.

Obtained recovery of over $1 million for Washington County in recovery actions and citizen suit against prior operators of landfill on county's property. 07-1549PK (2011)

Moore v. Cash Flow Investors, et al.

Obtained insurance coverage for past owner regarding contamination at service station and prevailed upon summary judgment and appeal in defense of lawsuit by current property owner seeking economic damages. CV03120245 (Or. Ct. App. 2010)

Acquisition of regional medical center for Providence Health System

Represented Providence Health System, Southern California in its acquisition of Tarzana Regional Medical Center, a general acute care hospital located in Tarzana, Calif., from affiliates of Tenet Healthcare. This transaction was unusual in that the real estate was acquired from a ground lessor (which ground leased the hospital property to Tenet) and the hospital business from Tenet. (2008)
