Marina C. Gruber
Counsel
Marina C. Gruber represents employers in single plaintiff discrimination and harassment actions before state and federal courts throughout California, as well as before state and federal administrative agencies. Her practice further includes representing employers in class actions involving California wage and hour law, including allegations of off-the-clock work, donning and doffing claims, and meal and rest break compliance.
In addition to her employment litigation practice, Marina represents and counsels employers in traditional labor matters and those involving the National Labor Relations Board, particularly with respect to arbitrations, organizing campaigns, and charges of unfair labor practices. Marina also brings subject matter expertise on California and federal prevailing wage laws and is experienced with advising contractors on wage audits, contract negotiations, and compliance.
Prevailing Wage Expertise
Prevailing wage compliance is challenging, and the requirements are draconian. Employers in California who perform covered work on public works projects know that compliance with the applicable laws is no easy feat.
Marina has advised and litigated numerous aspects of California's prevailing wage law at the administrative and trial court levels. She is deeply familiar with the challenges and complexities of the prevailing wage law and appreciates the difficulties of complying with all the nuances of California's ever-changing requirements.
Marina has defended employers faced with allegations of failure to pay the appropriate prevailing wage rate(s), employ apprentices, maintain certified payroll, failure of subcontractors to meet prevailing wage obligations, and disputes over whether the projects in question were public works at all. She has also counseled and litigated prevailing wage matters before the Department of Labor concerning the Davis Bacon Related Acts and in the U.S. District Court for the District of Rhode Island.
