Raphael Holoszyc-Pimentel is a member of DWT's media and entertainment group where he focuses his practice on intellectual property litigation and counseling. He has extensive experience in copyright, trademark, defamation, and First Amendment matters, among other issues facing content creators. He also has significant experience advocating for journalists under shield laws and rights of access to courts.

Practice Highlights

Intellectual property litigation

Navigates copyright and trademark disputes, including issues around infringement, fair use, chain of title, licensing, the DMCA, digital and social media, blockchain technologies, and generative AI. Represents clients in a wide range of media and entertainment industries, including publishers, record labels, broadcasters, websites, studios, distributors, and artists. As a musician, particularly passionate about music copyright.

Mora v. Koch

Successfully moved to dismiss defamation lawsuit brought by city court judge against office manager who had filed misconduct complaint against judge over his noncompliance with COVID masking rules in medical office. Obtained dismissal with prejudice and attorney’s fees under anti-SLAPP law. 190 N.Y.S.3d 575 (Sup. Ct. Dutchess Cnty. 2023)

Manno v. Campbell

Defended copyright infringement lawsuit against Irony Point, NBCUniversal, WarnerMedia, Michael Che, and others arising out of an episode of "That Damn Michael Che" on HBO Max. Prevailed on motion to dismiss. 2022 Copyright L. Dec. (CCH) ¶ 32,011 (S.D.N.Y. 2022)

Stone v. Carey

Represented Mariah Carey and Sony Music in defense against copyright infringement lawsuit arising from Carey’s iconic song "All I Want for Christmas Is You." (E.D. La. 2022)

Dershowitz v. Cable News Network, Inc.

Represents CNN in defamation lawsuit filed by Harvard Law professor emeritus Alan Dershowitz over CNN’s coverage of his defense of former president Donald Trump during his first impeachment trial. Successfully obtained summary judgment dismissing the case. (S.D. Fla., 11th Cir. Ongoing)

People v. Trump

Represents coalition of news organizations in obtaining access to criminal and civil proceedings in Manhattan District Attorney's prosecution and New York Attorney General's trial of former president Donald Trump. Secured right of journalists to photograph and attend arraignment and trial. (Sup. Ct. N.Y. Cnty. Ongoing)
