Brandon H. Johnson serves as a trusted advisor to startups, midsize enterprises, and Fortune 500 companies seeking to develop and distribute innovative technology products and solutions. Brandon has broad experience leading high-value technology transactions and navigating complex regulatory landscapes in a number of industries. Having been embedded for many years within several clients, Brandon approaches problems with a practical, customer-centric lens and is adept at collaborating with cross-functional teams to drive high-priority business objectives.

Brandon is a zealous advocate at the negotiation table, with a long track record of success. He has structured hundreds of commercial agreements for clients in the telecommunications, cloud and quantum computing, retail, industrial, hardware, software, IoT, XR, gaming, AI, and automotive sectors, among others. Examples include master services agreements and related statements of work, service level agreements, cloud services agreements, distribution and purchase agreements, partnership agreements, licensing agreements, nondisclosure agreements, transition services agreements, wholesale agreements, and policies and requirements documents.

On the regulatory front, Brandon is a leading expert in the field of digital accessibility, with significant experience counseling companies on compliance with the Americans with Disabilities Act (ADA), the Twenty-First Century Communications and Video Accessibility Act (CVAA), the European Accessibility Act (EAA), and other global accessibility laws, regulations, and standards. In addition, Brandon has architected in-house accessibility compliance, recordkeeping, and training programs; provided strategic advice on demand letters, complaints, and settlement agreements; supported clients in the conduct of accessibility audits of their digital assets; and drafted and reviewed accessibility-related terms in commercial agreements and public-facing policy statements.

Brandon also advises clients on communications regulatory requirements impacting digital products and services. His work in this space also includes representing clients in rulemaking and enforcement proceedings before the Federal Communications Commission (FCC), the National Telecommunications and Information Administration (NTIA), and other agencies.

Brandon maintains an active pro bono practice, with an emphasis on equal access and representation in the technology, media, and telecommunications industries; disability education; and immigration.

Technology transactions

Drafted and negotiated a wide range of commercial contracts to facilitate the development and commercialization of various technology products and services.

Communications regulatory product counseling

Advised on communications regulatory requirements impacting the launch, marketing, and deployment of radio frequency devices and cloud-based VoIP and messaging services.

Digital accessibility

Provided full suite of accessibility legal services, including product counseling and accessibility audit support; pre- and post-litigation counseling; and negotiating agreements carrying accessibility obligations for web, app, voice, video, and messaging services.
