Rasheed McWilliams is a first-chair trial counsel who leverages his nearly two decades of experience to help technology companies solve complex legal matters. Whether it's a company embroiled in legal claims involving complex technologies or a vendor failing to deliver on promised results or anything in between, Rasheed brings to bear the breadth of his extensive expertise to resolve his clients' disputes before trial and appellate courts nationwide. He has been lead counsel in over 150 intellectual property matters, including claims for patent infringement, trademark infringement, copyright infringement, and trade secret misappropriation.

Rasheed's clients include technology companies operating across diverse fields such as automotive parts, cannabis, computer hardware and software, e-commerce and electronic payment systems, electro-optical systems, food testing methods, haptic devices, High Intensity LED lighting, image processing, LED televisions, network security, nutritional supplements, pharmaceuticals, secure storage media, speech recognition, telephony and Voice over IP (VoIP), and video game developers.

Rasheed has extensive experience representing technology clients in commercial litigation matters spanning breach of contract claims and enforcing and defending claims under the Computer Fraud and Abuse Act, the Stored Communications Act, the California Consumer Privacy Act, and the Telephone Consumer Protection Act. He is further experienced with transactional matters in the fields of entertainment and technology, particularly in relation to intellectual property acquisition, divestment, and licensing agreements. Rasheed's practice also includes representing large companies in arbitrations before ADR providers, such as AAA, IFTA and JAMS.

Practice Highlights

Intellectual property litigation

Lead counsel in over 150 cases representing parties in disputes involving intellectual property claims involving a wide range of technologies and industries before trial and appellate courts nationwide, including the U.S. International Trade Commission.

Trial Practice

Obtained favorable rulings at numerous Markman hearings for patent plaintiffs and defendants. Obtained dismissal of consumer arbitrations in multiple AAA consumer arbitrations. Obtained complete defense verdicts in multiple trademark infringement trials. Obtained consent award admitting willful copyright infringement in private arbitration for film distributor. Obtained complete defense verdict for historically Black college on a motion for judgment as a matter of law.
 

Transactional Practice

Negotiated $200M credit facility and refinancing of credit facility for technology holding company. Negotiated resolution in pre-litigation dispute resulting from a failed software development project resulting in the recovery of one-third of the contract's cost. Representing client in negotiations to resolve a contract for a failed IT hardware development project. Advised client on acquisition of over 1,000 patents from two of the largest technology companies in China. Successfully negotiated technology license for over one hundred patents. Drafted opt-in and opt-out privacy policies, terms of use, data collection policies and marketing agreements for technology companies.

Negotiated content acquisition agreements, content distribution agreements, worldwide sales agreements, talent employment agreements, and film finance agreements for film and television production companies.
