Gillian Murphy helps employers of all sizes successfully navigate every aspect of the employment relationship. From recruiting to termination and everything in-between, Gillian teams with HR and management to find pragmatic solutions that limit legal risk and meet business objectives.

Gillian spends the majority of her time advising clients on a variety of legal issues such as leave and disability law compliance, policy development, executive compensation, and discrimination investigations. She also regularly conducts management and front-line employee training programs on a range of employment topics and is known for her engaging presentation style. While Gillian serves employers across all industries, she has particular expertise in the restaurant and hotel space, as well as the nonprofit sector.


Practice Highlights

Workplace investigations

Conducted numerous workplace investigations involving complicated allegations of harassment and discrimination, including instances involving the highest levels of management, as well as working with outside investigation firms to ensure company’s interests are well-represented.

Training

Developed companywide management and harassment training strategy for multistate company that included in-person sessions and comprehensive training materials.

Reductions-in-force

Assisted multiple fortune 500 companies with reductions-in-force strategies. Provided counsel throughout mass layoff from selection through post-layoff litigation.

Whistleblower retaliation defense

Defended Battelle Memorial Institute in a Department of Energy whistleblower retaliation case brought under the Whistleblower Protection section of the National Defense Authorization Act. Plaintiff alleged that she was removed from her position after making a protected disclosure regarding management's alleged efforts to change a root cause analysis report concerning an improper payment of $530,000 to a fraudulent entity. Secured a unanimous defense verdict following two-week trial. Busselman v. Battelle Memorial Institute (E.D. Wash. 2019)

Arbitration for national restaurant chain

Successfully obtained full judgment for national restaurant chain at arbitration against employee's extensive sexual harassment and retaliation claims. (2010)

Response to demand letter in connection with reduction in force for WALTER DORWIN TEAGUE ASSOCIATES INC

Represented Walter Dorwin Teague Associates, Inc. ('Teague') in connection with three EEOC charges regarding three former Teague employees alleging wrongful termination due to age discrimination. The EEOC dismissed the charges. (2010)

Munday v. Western Peterbilt, Inc.

Obtained summary judgment for large transportation company on all claims in a sexual harassment and retaliation case. (2009)

Race and national origin discrimination case for local luxury hotel

Successfully defeated six related EEOC charges against local luxury hotel alleging race and national origin discrimination, which included representing client throughout lengthy investigation and EEOC interview process. (2007)
