David leverages more than 20 years of experience in privacy and security to guide clients through the challenge of complying with rapidly multiplying and complex laws in a multi-jurisdictional environment. Drawing on his extensive knowledge of the full spectrum of federal, state, and international privacy and data protection laws, David advises clients regarding a wide range of difficult privacy questions and helps them understand and manage risk. He works closely with clients to understand their unique needs and concerns and to develop tailored and pragmatic solutions that meet their legal and business requirements.

David counsels clients in many different industries, including cloud services, business-to-consumer/B2C, marketing, communications and networking, app development, health care, entertainment, gaming, sports, artificial intelligence (AI/ML), and education. A longtime leader in privacy and security law, David is an accomplished author and a prolific presenter at conferences, trade organizations, and bar associations. He also conducts in-house training and coaching for clients.

Structuring data transactions to achieve client objectives while managing risk and meeting privacy regulatory obligations. Partnering with clients to meet their transactional needs efficiently in different data-use cases and processing scenarios.

Incident response

Leading clients through the challenge of a privacy or security incident in a manner that addresses client concerns, manages risk, and meets regulatory requirements.

Privacy compliance*

Lead outside counsel advising clients on international, federal and state privacy and security laws, including the California Consumer Privacy Act (CCPA/CPRA), the Virginia Consumer Data Protection Act (VCDPA), the Colorado Privacy Act (CPA), and other new state privacy laws; the General Data Protection Regulation (GDPR); the Family Educational Rights and Privacy Act (FERPA); the Telephone Consumer Protection Act (TCPA); the Children's Online Privacy Protection Act (COPPA); Gramm-Leach-Bliley Act (GLBA); the Health Insurance Portability and Accountability Act (HIPAA); the Telephone Consumer Protection Act (TCPA), and many others. Advised clients regarding data subject access requests and handled responses and related disputes.

Privacy and data transactions*

Negotiating a vast range of contracts with data privacy implications, including agreements involving service providers, data processors, cloud services, data sales, marketing, analytics, data centers, networking, databases, colocation, SaaS, IoT, content delivery networks, dark fiber, and IP transit.

Privacy and data processing*

Advising clients regarding buying and selling personal information, marketing and sales strategies, analytics, AI, privacy policies, supply chain privacy and security risks, privacy program maturity, data mapping, online sales and mobile marketing, data privacy and security due diligence in M&A transactions, and TCPA compliance programs. Combining deep understanding of both privacy laws and technology to help clients understand the legal implications of sharing and processing data and how to mitigate risk.

Security compliance and incident response*

Lead outside counsel on numerous data security incident responses, which involved handling global reporting obligations to consumers, regulators, and data protection authorities. Responding to wire transfer fraud incidents, including working with law enforcement and forensic IT vendors and handling negotiations with affected counterparties.
