Dipa thinks like a member of your team. She strives to understand her clients' business environment and challenges, and will provide appropriately tailored advice. She uses her deep knowledge of employee benefits related laws to craft novel solutions.

Dipa's clients range from employers with thousands of employees, to those with just a few. She provides sophisticated advice and counsel on employee benefits related laws (e.g. ERISA, the tax code, ACA, COBRA, and HIPAA). She has in-depth knowledge and insight on a wide variety of plans: defined contribution (401(k), 403(b), money-purchase and profit-sharing), defined benefit, health and welfare (wrap, HRA, retiree, MEWA), fringe benefit, non-qualified deferred compensation, and cafeteria. Dipa also represents employers in M&A-related benefits issues. She is regularly called upon to lead training sessions for clients, for example, fiduciary HIPAA and ERISA training.

Practice Highlights

IRS/DOL representation

Representing clients in successfully abating millions of dollars assessed as employer shared responsibility payments (ESRP), and representing clients with IRS and DOL audits.

Plan drafting

Drafting retirement plans, health and welfare plans, and associated documents.

Advice and counsel

Providing sophisticated ongoing advice and counsel related to plan design, including correction of operational and other errors relating to benefits plans, including through the IRS' EPCRS.

Defined benefit plans

Researches issues and provides advice regarding defined benefit plans, such as minimum funding requirements and changes to mortality and interest rate factors; prepares documentation relating to defined benefit plans, such as forms and summary plan descriptions; prepares determination letter applications; and advises on ongoing administration matters, such as claims under defined benefits plans. Health and welfare plans

Dipa advises on all aspects of health and welfare plans, including multiple employer welfare arrangements. For example, she assists employers with designing compliant wellness programs, on-site medical clinics, and telemedicine services. Dipa has counseled clients on ACA compliance and reporting, especially structuring benefits to avoid ACA penalties and administering the look-back method. Dipa also assists employers with operational issues related to health and dependent care FSAs, and nondiscrimination testing.

Non-qualified deferred compensation plans

Dipa has designed and drafted tailored non-qualified deferred compensation plans for her clients.
