The EEOC has finally issued proposed regulations addressing how the Americans with Disabilities Act applies to corporate wellness programs. The proposed regulations provide guidance on the extent of which employers may use incentives to encourage employee to participate in wellness programs that include disability-related inquiries and/or medical examinations, and how the ADA's rules interact with the final regulations under HIPAA and the ACA.

We discussed the proposed ADA regulations and the potential impact on programs that are compliant with the HIPAA/ACA regulations.
