In a whirlwind week ending December 16, the National Labor Relations Board reversed four controversial decisions of the Obama-era board. These decisions impact all employers, union and non-union, and will affect union organizing, workplace rules and employee handbooks, the joint employer analysis under the National Labor Relations Act, and when changes may be made during bargaining over a successor agreement. In addition to these decisions, the board has commenced the rule-making process to reconsider the “quickie election” rules promulgated during the Obama administration. While this flurry of decisions marked the end of Chairman Miscimarra’s term, a new general counsel has suggested that numerous other decisions may be revisited when the board returns to full strength.
