Vidhya Prabhakaran is a California energy attorney with substantial experience before the California Public Utilities Commission, the California Energy Commission, the California Air Resources Board, the California Independent System Operator, and the California Legislature working for his energy clients as well as clients in the transportation, telecommunications, and water industries.

Together with the other members of the DWT energy practice group, Vid assists clients with formulating, presenting, and advocating policy positions on greenhouse gas reduction, procurement, ratemaking, and safety.  Vid also assists clients with regulatory approvals, utility rate and certificate proceedings, acquisitions and dispositions of regulated assets, energy-related contracts, project finance, energy-related dispute resolution, and energy litigation.

Vid’s clients include: South San Joaquin Irrigation District, the City of Long Beach, Uber Technologies Inc., the California Community Choice Association, Marin Clean Energy, Peninsula Clean Energy, Powerex Corporation, Bear Valley Electric Service, and the Morongo Band of Mission Indians.

As chair of the DWT energy practice and as a member of the firmwide executive committee, Vid focuses a great deal on the changing nature of the profession and has served on a number of committees and taskforces inside and outside the firm focused on modernizing the practice of energy law in California, incorporating technology into the practice, promoting diversity in the profession, and improving client service.

State Regulatory Electric Counsel

Negotiating power purchase agreements on behalf of electric generators, energy marketers and energy service providers to meet California resource adequacy and renewable portfolio standard compliance obligations. (Ongoing)

Renewable energy for SolarCity

Representing in administrative proceedings regarding rules and requirements applicable to the development and marketing of solar PV systems in compliance with the California Solar Initiative (CSI) and California Public Utilities Commission rules implementing the CSI. (Ongoing)

Regulatory - electric for South San Joaquin Irrigation District

Representing in administrative and judicial proceedings pertaining to SSJID's plan to expand the scope of its services to include retail electric service within its existing service territory in California's Central Valley, including CEQA compliance and administrative proceedings before the California Public Utilities Commission, San Joaquin County Planning Commission, and San Joaquin Local Agency Formation Commission. Representing the City of Long Beach in rate and other natural gas proceedings before the CPUC. (Ongoing)

Transaction and regulatory counsel for Marin Clean Energy

Providing advice and counsel to California’s first community choice aggregator in various energy-related transactions and regulatory matters. (Ongoing)

Representing Chevron Pipe Line Company in rate and other proceedings before the CPUC. (Ongoing)

Mergers & acquisitions for Algonquin Power & Utilities Corp.

Formed a new investor-owned electric utility, Liberty Utilities (CalPeco Electric) consisting of electric utility assets (in the Lake Tahoe area of California). Representation included the negotiation of asset purchase agreement and other key transaction documents for Liberty and also obtaining federal and state regulatory approvals. (2011) Read more

Obtaining all state regulatory approvals required for acquisition of two major California water companies. (Ongoing)

Development – renewable for NaturEner

Representing NaturEner USA in obtaining various California and federal regulatory approvals associated with the development of, financing of, and sales of power and renewable energy credits from NaturEner’s Glacier 1, Glacier 2, and RimRock wind energy projects (Ongoing)

Long-term procurement proceedings

Representing independent power producer before the CPUC with respect to a multi-phase rulemaking addressing long-term energy procurement policies. (Ongoing)

Resource adequacy proceedings

Representing independent power producer before the CPUC with respect to rulemaking addressing resource adequacy issues and establishing flexible performance characteristics for energy generating facilities. (Ongoing)

Development - renewable for Bear Mountain Wind Limited Partnership

Providing advice to out-of-country project developer regarding the California Tradable Renewable Energy Certificate (TREC) program and obtaining regulatory approvals before the California Energy Commission. (Ongoing)

Renewable energy

Providing advice to geothermal generators operated by Calpine Corporation in the Geysers Geothermal Area in Northern California with respect to commercial matters, disputes, and regulatory issues. (Ongoing)
