Scott Commerson focuses his litigation practice on intellectual property and brand protection, including trademark, trade dress, copyright, unfair competition, and false advertising litigation. Scott also has extensive experience litigating trade-secret and employee-mobility cases, and has obtained temporary restraining orders and preliminary injunctions to enjoin misappropriation. In addition, Scott regularly defends class actions brought under California's consumer protection laws.

Scott represents clients in courts and arbitration tribunals across the country. He has won numerous dispositive and class certification motions, and has litigated cases through trial, arbitration, and appeal. Scott is admitted to practice before courts in California and Washington.

Brand protection litigation

Overseeing brand protection and anti-counterfeiting litigation on behalf of one of the world's largest retailers.

Prevailed in unfair competition and trade secret case

On behalf of art manufacturer, obtained complete defense award following nine-day arbitration hearing in action seeking over $10 million. Also awarded full relief on client’s counterclaims and 100% of client’s costs and fees.

Obtained summary judgment for footwear company

On behalf of footwear manufacturer, obtained summary judgment on claim that client’s use of IPANEMA mark for sandals infringed on plaintiff’s federally registered IPANEMA trademark for swimwear.
