Scott Commerson focuses his litigation practice on intellectual property and brand protection, including trademark, trade dress, copyright, unfair competition, and trade secret litigation. Scott has obtained ex parte seizure orders, temporary restraining orders, and preliminary injunctions on behalf of IP owners. Scott also helps clients develop comprehensive enforcement programs to protect their brands from infringement. In addition to his IP practice, Scott regularly defends class actions brought under California's consumer protection laws.

Scott represents clients in courts and arbitration tribunals across the country, as well as before the Trademark Trial and Appeal Board. Scott is admitted to practice before courts in California and Washington.

Scott has been named to the Daily Journal's Top 100 Intellectual Property Attorneys in California, and he is recognized by the World Trademark Review for enforcement and litigation.

Brand protection litigation

Overseeing brand protection and anti-counterfeiting litigation on behalf of a major retailer.

Prevailed in unfair competition and trade secret case

On behalf of art manufacturer, obtained complete defense award following nine-day arbitration hearing in action seeking over $10 million. Also awarded full relief on client's counterclaims and 100% of client's costs and fees.

Obtained summary judgment for footwear company

On behalf of footwear manufacturer, obtained summary judgment on claim that client's use of IPANEMA mark for sandals infringed on plaintiff's federally registered IPANEMA trademark for swimwear.

Trademark and Intellectual Property Litigation

Anti-counterfeiting litigation

Managing anti-counterfeiting and trademark enforcement litigation for major retailer, including filing dozens of enforcement actions each year. (W.D. Wash. Ongoing)

Reviews abuse litigation

Managing more than two dozen cases against websites or groups that facilitate fake product reviews. (King Cty. Sup. Ct. (Wash.) Ongoing)

Copyright litigation

Representing multiple studios in actions against IPTV service operators that offered unauthorized access to pirated channels, movies, and shows. (C.D. Cal.; M.D. Pa. Ongoing)

Trademark litigation

Obtained $13 million judgment and permanent injunction against bad actors who sold counterfeit batteries. (W.D. Wash. 2025)

Copyright litigation

Representing client in software copyright dispute. (C.D. Cal. Ongoing)

Trade Secret and Non-Compete Litigation

Confidential dispute

Negotiated favorable prelitigation settlement in high-value trade secret dispute between healthcare companies. (C.D. Cal. 2022)

BillGo v. Wex

Filed motion for preliminary injunction to enjoin client's competitor from enforcing an invalid contractual provision against former employee. Secured stipulated judgment that competitor would not seek to enforce the provision. (Los Angeles Cty. (Calif.) Super. Ct. 2019)

Atlantis Events, Inc. v. Vacaya, LLC

Obtained temporary restraining order and preliminary injunction enjoining former employees from using proprietary lists for competing company. (Los Angeles Ct. 2018-2020)

Baker v. Alcoa, Inc., Arconic Global Fasteners & Rings

Obtained summary adjudication for aerospace manufacturer on plaintiff's claims for discrimination, harassment, and retaliation, and subsequently obtained—on the eve of trial—dismissal with prejudice of plaintiff's remaining wrongful termination and common law claims. (Los Angeles Cnty. (Calif.) Super. Ct. 2018)

Confidential arbitration

Defended large engineering consulting firm in action by former president alleging breach of stock purchase agreement. Obtained dismissal of all claims before hearing and reimbursement of attorneys' fees as prevailing party under the agreement. (AAA 2018)

Hall v. HP Inc.

Defending HP Inc. in class action alleging fraud and unfair competition based on printer ink subscription plan. (C.D. Cal. Ongoing)

Greg Buchwalter v. Amazon.com, Inc., et. al.

Represented Amazon in class action alleging violation of Section 1983. Obtained dismissal and summary affirmance by Ninth Circuit. (C.D. Cal. 2024; 9th Cir. 2024)

Kellie Williams v. Amazon.com, Inc., et. al.

Represented Amazon in class action alleging violation of Unruh Act. Plaintiff voluntarily dismissed action following filing of Demurrer. (Los Angeles Cty. (Calif.) Super. Ct. 2022) 

Andrews v. Ring, LLC

Defended putative class action alleging false advertising in connection with sale of home security cameras. Obtained denial of class certification. (C.D. Cal. 2020)

Krinsk v. The Economist

Defended putative class action alleging violations of California's Auto-Renewal statute. Obtained voluntary dismissal with prejudice following motion practice. (S.D. Cal. 2018)
