Alexa Graumlich is an experienced employment litigator who defends employers in a wide variety of industries against claims for harassment, retaliation, discrimination, wrongful termination, and failure to accommodate. She also defends employers facing complex class and representative actions involving wage-and-hour claims, including California Private Attorneys General Act (PAGA) actions. Alexa represents clients in federal and state court, in arbitration, and before administrative agencies in all stages of litigation.

In addition to her employment litigation experience, Alexa partners with employers to navigate state and federal employment laws and identify solutions for compliance. Alexa also maintains a pro bono practice, focusing on immigration and asylum.

Wage-and-hour litigation

Representing employers in wage-and-hour class and representative actions involving meal and rest break compliance, timekeeping, regular rate of pay and overtime, expense reimbursement, tipping and gratuities, wage statement violations, misclassification, and other alleged violations of wage-and-hour laws.

Single-plaintiff litigation

Defending employers in single-plaintiff actions alleging discrimination, harassment, retaliation, failure to accommodate, and wrongful termination. Alexa has experience in all phases of litigation, including initial fact investigation, written discovery, depositions, motion practice, and trial.

Employment advice

Counseling employers and drafting policies to ensure compliance with federal, state, and local laws.

Class Action

Wage-and-hour class and PAGA representative action for movie theater chain

Defending a movie theater chain in a wage-and-hour class and PAGA action involving claims for meal and rest period violations, unpaid minimum and overtime wages, failure to reimburse expenses, waiting time penalties, inaccurate wage statements, and civil penalties under PAGA. (Riverside County (Cal.) Super. Ct.)

Wage-and-hour and PAGA representative action for hotel group

Obtained a favorable settlement in a wage-and-hour class and PAGA action brought against a boutique hotel group involving claims for unpaid tips, unpaid minimum and overtime wages, meal and rest period violations, inaccurate wage statements, waiting time penalties, failure to reimburse expenses, and civil penalties under PAGA. (Los Angeles County (Cal.) Super Ct. 2023)

Wage-and-hour and PAGA representative action for a prepared food manufacturer and distributor

Obtained a favorable settlement in wage-and-hour class action and PAGA action brought against a prepared foods manufacturer and distributor for alleged unpaid minimum and overtime wages, meal and rest period violations, inaccurate wage statements, waiting time penalties, reimbursement claims, and civil penalties under PAGA. (San Diego County (Cal.) Super. Ct. 2022)

Summary judgment in FLSA misclassification case*

Obtained summary judgment finding that plaintiff, an insurance underwriter, was not misclassified as exempt under the FLSA. (N.D. Cal. 2020)
