Daniel Leigh is a skilled class action and commercial litigator with a practice that sits at the intersection of technology, consumer issues, and privacy. With litigation wins ranging from early dismissal with prejudice to appellate victories, Daniel helps household names in consumer-facing industries solve complex business and litigation problems. Daniel has deep experience in a number of consumer-related areas, including representing technology companies in putative class actions and other matters involving privacy claims; helping a large online retailer prosecute of campaign of consumer protection lawsuits against bad actors that defraud its customers; and defeating putative mislabeling class actions in the food and beverage space. In addition to consumer-related litigation, Daniel has deep experience helping companies defend their intellectual property rights and maintains an active pro bono practice. Regardless of the industry or stage of the case, Daniel employs creative legal reasoning, sharp legal writing, and persuasive oral advocacy to help his clients win and achieve their business objectives.

Consumer class actions

Daniel specializes in helping companies defeat potentially high-exposure consumer class actions. Notable wins include Vitort v. The Kroger Co., 2023 WL 3143690 (9th Cir. Apr. 28, 2023) (affirming dismissal), Degioanni v. The Kroger Co., 2024 WL 5402310 (S.D. Tex. Nov. 5, 2024) (striking class allegations at the pleading stage), and Garland v. The Kroger Co., 2025 WL 474914 (S.D. Cal. Feb. 12, 2025) (dismissing with prejudice).

Internet privacy litigation

Daniel represents technology companies in putative class actions and other matters involving the California Invasion of Privacy Act, the federal Wiretap Act, and the Video Privacy Protection Act.

Consumer protection litigation

Daniel helps a large online retailer protect its customers by managing a campaign of plaintiff-side litigation against fraudsters who sell fake online reviews and fraudulent accounts. Daniel's efforts have resulted in the seizure of more than a dozen websites that offered fraudulent services that harmed his client and its customers.

Represented The Kroger Co. in the successful defense on appeal of dismissal with prejudice of mislabeling claims involving "Just Fruit" fruit spread. No. 22-35185, 2023 WL 3143690 (9th Cir. Apr. 28, 2023)

Garland v. The Kroger Co.

Won dismissal with prejudice of mislabeling claims involving foods that contained allegedly synthetic malic acid. No. 24CV240-LL-JLB, 2025 WL 474914 (S.D. Cal. Feb. 12, 2025)

Degioanni v. The Kroger Co.

Represented The Kroger Co. in mislabeling lawsuit involving foods that contained allegedly synthetic malic acid. Successfully moved to strike class allegations at the pleading stage. No. 4:24-CV-00528, 2024 WL 5402310 (S.D. Tex. Nov. 5, 2024)

Internet tracking class action

Represent a major technology company in a putative class action alleging that session replay technology violated privacy rights. (N.D. Cal. Ongoing)

Amazon Techs. v. Amazon Home Warranty

Represented Amazon Technologies, Inc. in trademark infringement litigation against a company using the name "Amazon Home Warranty." Obtained a consent judgment and permanent injunction barring future infringement. (S.D.N.Y. 2023)
