Brian Martinez

Brian Martinez counsels employers on their most important labor and employment matters, including litigation strategy. He has experience in all phases of litigation, having taken multiple cases to trial.
Brian's expertise spans the full range of the employment relationship—he provides employers of all sizes advice on policies, procedures, and handbooks; union and non-union workforce issues; wage-and-hour laws; trade secrets and IP issues; employee trainings, discipline, terminations, and reductions in force; employee raiding and mobility; discrimination, harassment, wrongful termination, retaliation, and whistleblower claims; and California Labor Code issues. Before joining DWT, he was a vice president and assistant general counsel at a multinational media and entertainment company, where he served as lead counsel in labor arbitrations and grievances, mediations, federal and state agency investigations, and demand letter responses. As in-house counsel, he also managed class and single-plaintiff litigation matters before federal, state, and arbitral tribunals in jurisdictions from California to New York and overseas.
Outside of his daily practice, Brian has provided pro bono legal representation for asylum seekers, monolingual Spanish-speaking parents whose children required special education services from school districts, LA-area homeless veterans, and others. His "tireless advocacy for housing and services on behalf of homeless veterans" received congressional recognition.
