James Moon defends companies in their most important business litigation matters. Whether representing publicly traded companies, emerging ventures, or startups, James analyzes and executes on a plan of action to end the litigation problem decisively from Day One. James's practice involves a broad range of complex commercial litigation, with particular emphasis on class-action matters and business disputes. James has substantial experience in all aspects of federal and state civil litigation, including large-scale discovery, complex motion practice, and appeals. He prides himself on his ability to secure swift and efficient resolution of high-exposure class action and business cases through successful dispositive pre-trial motions, oppositions to class certification, or favorable settlements. But when necessary, James has obtained decisive victories for his clients after full trials and arbitrations, including a unanimous seven-figure jury verdict and complete defense victories.

James provides actionable legal advice and roadmaps that cut through the noise of modern litigation so that his clients can focus on their business and passion for serving their own clients and customers.

Practice Highlights

Class-action defense

James has represented dozens of companies in class-action litigations. Each class action defense is unique but the goal is the same: minimize or eliminate the litigation exposure as early as possible. James has repeatedly achieved complete defense victories in class actions through early dispositive and quasi-dispositive motions. Representative actions in this space include Andrews v. Ring LLC (C.D. Cal.), Shenzen Shileziyou Techs. Co. v. Amazon.com, Inc. (N.D. Cal.), O'Neil v. The Kroger Co. (Los Angeles Sup. Ct.), Handy v. LogMeIn Inc. (E.D. Cal.), and Grant v. NFL Players Association (C.D. Cal.

Business disputes

James has represented numerous businesses in lawsuits between competitors. The outcome of these battles could define markets and industries. His recent successes include a unanimous seven-figure jury verdict after a two-week federal trial in a copyright infringement action and a complete defense verdict after a state court bench trial. At the other end of the spectrum, James has obtained temporary restraining orders and preliminary injunctions to prevent the infringement of a business' most important intellectual property or outright dismissals on early motions to dismiss. Representative actions include Charter School Capital Inc. v. Charter Asset Management LLC (C.D. Cal.), California Credits Group v. Williams Lea, Inc. (Los Angeles Sup. Ct.), Atlantis Events Inc. v. Vacaya LLC (Los Angeles Super. Ct.), and Lavera Skin Care N.A. Inc. v. Laverana GmbH Co. KG (W.D. Wash. & 9th Cir.).

Complex litigation

James is well-versed in all manner of complex commercial litigation and arbitrations, including contract and partnership disputes, shareholder derivative actions, and consumer cases. No matter the stakes, James is able to provide value for business clients looking to manage risk and swiftly address the cloud created by legal proceedings. Representative actions include Thompson v. Wells (Los Angeles Super. Ct.), Sokolowski v. Adelson (D. Nev. & Nev. Dist. Ct.), Thermopylae Capital Partners, LP v. Simbol Inc. (Del. Ch.), and various arbitration matters for Amazon.com, Inc. and T-Mobile USA, Inc.

Food & beverage industry matters

James routinely handles litigation matters for clients in the food and beverage industry. He resolves issues ranging from presuit demands under the Consumer Legal Remedies Act to full-blown class action litigation. Representative actions include Lighthiser v. EVR Foods (S.D.N.Y.) and various Kroger class action matters involving claims of false advertising of various food and beverage products (C.D. Cal., E.D. Cal., N.D. Cal., D. Or.).
