Data privacy and cybersecurity issues have become mission-critical C-Suite issues because they directly affect a company's strategy, legal compliance obligations, financial health, and reputation. Data has become one of the most valuable assets for private and public sector organizations alike. The Internet, artificial intelligence (AI) and machine learning, biometrics, and other transformative technologies employ powerful tools to collect, combine, analyze, use, store, and dispose of personal information. Questions abound regarding the responsibility that comes with the extraordinary power of data-driven generative AI. These rapidly changing data trends create a breathtaking range of compliance and liability issues, while raising the stakes for protecting such data in challenging risk environments, whether internal vulnerabilities or criminal cyberattacks or other threats. New laws and obligations are continually emerging from legislators, regulators, and the courts to address the corresponding privacy and cybersecurity implications. This annual program focuses on the latest developments, along with strategic approaches, to keep attorneys and other privacy and cybersecurity professionals up-to-date and ready to respond effectively in this complex and dynamic area.

On May 19, Partner Ben Gipson will join the panel "The Intelligent Workplace: Privacy and Cybersecurity in the Era of AI and Algorithmic Decision-Making." This panel will discuss employment privacy considerations for employers in applying AI tools to augment and transform traditional selection, monitoring, and other employment processes. After completing this session, participants will be able to:

  • Identify employment privacy considerations for using algorithmic decision-making technology in hiring and other employment decision making processes
  • Understand the changing landscape for monitoring employee presence, performance, and productivity, from key-stroke loggers to eye-movement tracking
  • Recognize your obligations under domestic and global laws governing AI tools and employment
  • Discuss use of AI and policy considerations for managing use of AI in the workplace
