JUNE 2, 2026 – Davis Wright Tremaine LLP has filed a lawsuit against the attorney general of Idaho for violating the First Amendment rights of Mayday Health, a nonprofit provider of reproductive health information.

The lawsuit alleges that Mayday has been forced to cancel a planned advertising campaign in Idaho out of concern that the organization will be subject to criminal penalties and civil fines.

Mayday had intended to bring to Nampa, Idaho, a mobile billboard that says "Pregnant? Don't Want to Be? Learn more at www.maydayhealth.com." Despite repeated outreach from DWT attorneys on Mayday's behalf, Idaho's AG has refused to disclaim prior statements asserting that state law authorizes him to punish Mayday for publishing truthful, noncommercial information.

Mayday's complaint asks the court to declare that the planned advertising, and the website it links to, are fully protected speech, and to enjoin the AG from penalizing Mayday for engaging in this First Amendment-protected activity.

With abortion restrictions in place in more than a dozen U.S. states, including Idaho, Mayday is on a mission to publicize the options still available to those who are pregnant and don't want to be, including the safe and effective use of FDA-approved abortion pills such as mifepristone and misoprostol. Mayday is a donor-funded educational resource that provides people with the information they need to make informed reproductive healthcare choices. It does not benefit from the sale of abortion medication and has no customers.
