Maria Browne represents cable, telecommunications, and broadband service providers in matters related to infrastructure deployment, including with regard to pole attachments and access to public rights-of-way. She also advises companies on compliance with laws and regulations governing communications and digital technology companies, including those requiring technology, services and equipment to be accessible to persons with disabilities.

Maria has appeared before the FCC and state regulatory bodies in numerous states including Connecticut, California, Florida, Georgia, Massachusetts, New Hampshire, New Jersey, New York, Washington, D.C., Vermont, and Virginia. She routinely works with local counsel to help secure favorable outcomes on behalf of her clients before state and federal courts.

Practice Highlights

Accessibility

Assists clients in ensuring compliance with laws and rules requiring digital technology, web content, communications services and equipment, and video programming be accessible to persons with disabilities. Laws and regulations include the 21st Century Communications Video and Accessibility Act and implementing FCC regulations, the Americans with Disabilities Act, Section 508 of the Rehabilitation Act, and numerous state laws as well as those of other nations, including Canada.

Infrastructure deployment

Represents clients before the FCC and state public-service commissions in disputes and rulemaking proceedings concerning broadband infrastructure deployment, including with respect to pole attachment rates, terms, and conditions. Negotiates legally compliant pole attachment and conduit occupancy agreements with utilities nationwide. Advises clients concerning the legality of pole attachment rates, terms, and conditions and state and local requirements governing access to public rights-of-way and private easements. Assists in drafting legislation and ordinances pertaining to infrastructure deployment.

Advises clients on various FCC regulatory matters.

Accelerating wireline broadband deployment by removing barriers to infrastructure investment

Represent NCTA in ongoing rulemaking proceeding relating to expediting and improving the pole access process for broadband providers.

Represented NCTA in rulemaking proceeding related to cost allocation of pole replacements and improving pole access process for broadband providers.

Represented NCTA Petition for Expedited Declaratory Ruling related to cost allocation of pole replacements necessitated by attachments. Secured a favorable decision on behalf of the client.

Represented Crown Castle on matters pertaining to rents charged by Com Ed for accessing utility infrastructure. (2019)

Mass DTC Complaint Proceeding Docket 22-4

Obtained favorable Mass DTC ruling in complaint proceeding brought on behalf of CRC Communications, Inc. d/b/a OTELCO against Verizon New England, Inc. and Massachusetts Electric d/b/a National Grid ordering, among other things, that Verizon and National Grid allow OTELCO to use certain time and cost saving construction techniques when attaching broadband facilities to utility poles.
