Vandana Kapur has experience helping a range of clients navigate difficult situations in the workplace. She has counseled and defended organizations of various sizes in the healthcare, arts, film and entertainment, fitness, banking, manufacturing, technology, produce, and restaurant industries, among others, against a variety of employment law claims. She has extensive experience handling single plaintiff, representative action, and class action claims in both state and federal court.

Vandana works to understand the full range of circumstances surrounding each matter, along with the business needs and preferences of the client, to achieve the best outcome possible. She has unique expertise in effectively handling challenging and sensitive facts and situations, and enjoys partnering with clients to resolve these issues. Vandana has experience with the Fair Employment Housing Act ("FEHA"), Private Attorney General Act of 2004 ("PAGA"), Title VII of the Civil Rights Act of 1964, defamation and contract law, and California Labor Code requirements.

Vandana served on the board of the South Asian Bar Association of Southern California for several years, concluding with her role as co-President for the 2020/2021 term. She remains a participant in diversity initiatives both inside and outside the firm.

Practice Highlights

Single plaintiff litigation

Handling every aspect of single-plaintiff employment litigation, including fact investigation, discovery, depositions, motion practice, oral argument, and mediation. Gaining early understanding of the factual circumstances and legal issues at stake, in order to determine the most efficient and effective strategy for the particular case. Obtaining favorable results, including excellent settlements via both direct negotiation and mediation, as well as summary judgment.

Wage and hour litigation

Litigating complex wage and hour litigation, including PAGA actions, involving unique and cutting edge legal issues. Applying current state of the law to best approach the ever-changing landscape of representative actions in California.

Advice and counsel

Counseling clients from a range of industries on complex issues, including preparing various agreements, to guide employers through sticky and niche areas of the law. Topics of advice including, but not limited to, terminations, wage and hour matters, misclassification, and onboarding documents and employment contracts.

Gonzales v. Providence Saint Joseph Health

Won anti-SLAPP motion on wrongful termination action. Case dismissed in its entirety. Upheld on appeal. (2021)

Sportsman v. A Place for Rover, Inc.

Removed PAGA misclassification action to federal court, under novel theory and after multiple procedural victories, ultimately leading to summary judgment ruling. (2021)

Healy v. Providence Health System - Southern California

Defended action involving claims of age discrimination and defamation. Reached very favorable resolution based on compelling summary judgment arguments. (2020)

Gonzales v. Artrajchkit

Won summary judgment motion, dismissing defamation action in its entirety. (2019)

Greene v. Pacific Toxicology

Successfully resolved matter involving claims of pregnancy discrimination pre-litigation, on terms highly favorable to client. (2019)
