Kwan Park's practice focuses on finding solutions to and litigating complex labor and employment issues, including trade secrets and employee mobility matters and putative class, collective, and representative wage-and-hour actions.
He has, for example, successfully opposed a preliminary injunction motion in a non-compete dispute involving a plaintiff's top executive.
Kwan works both sides of the "v" in trade secrets and employee mobility matters, including investigating and prosecuting claims of employee and customer raiding, unfair competition, and related claims, and defending against the same. He uses his experience to partner with clients to operationalize on best practices to protect their most valuable assets, such as their intellectual property and workforce, and minimize risks when hiring or separating key individuals.
Kwan also regularly defends clients against high-stakes wage-and-hour actions, including those under the California Private Attorneys General Act (PAGA). He has represented employers in key sectors, such as energy, financial services, healthcare, retail, supply chain, and technology, and litigated a wide range of wage-and-hour issues, including alleged exempt status or independent contractor misclassification, off-the-clock work, noncompliant meal and rest periods, unreimbursed business expenses, and waiting time penalties, among others.
Kwan has consistently been recognized as "One to Watch" by Best Lawyers in labor and employment law. He is a graduate of Stanford Law School, where he was a senior editor of the Stanford Law Review. He received his Bachelor of Science in Industrial and Labor Relations from Cornell University.
