Clayton Graham helps clients buy, develop, and sell real estate, as well as navigate land development issues of all types. His projects range from large infrastructure and essential public facility projects to single-site developments, including mixed-use projects, distribution facilities, datacenters, and other industrial uses. Clayton has assisted clients on significant, high-profile, and contested development projects in the Puget Sound region and beyond. As part of DWT's multidisciplinary land development team, Clayton helps clients site, permit, and develop their projects, and—where necessary—litigate land use matters. He also serves as outside counsel for many client-driven development projects.

Clayton has represented Olympic Property Group/Pope Resources, the Port of Seattle, The Seattle Times Company, Sound Transit, and Waste Management.

Practice Highlights

Essential public facilities

Representing developers of essential public facilities throughout the state of Washington, including several psychiatric and medical facilities, as well as stations and light rail facilities for Sound Transit's East Link and Lynnwood Link extensions.

Hotel development

Assisted various clients with the siting, acquisition, permitting, development, and disposition of hotel projects in Washington and Oregon, including condominiumized high-rise projects in downtown Seattle and Portland.

Master planned developments

Representing developers of planned communities, including the master developer of the National Historic Town of Port Gamble, Wash., on comprehensive plan, zoning, and development agreement to make way for mixed-use redevelopment of the historic town site.

Real estate development for Sound Transit

Assist Central Puget Sound Regional Transit Authority (Sound Transit) with development and permitting of transit-oriented mixed-use developments, light-rail stations, tracks, and related facilities, including Sound Transit's East Link and Lynnwood Link Extension Projects through multiple Puget Sound cities. (Ongoing)

Conservation land transactions for Boy Scouts

Represented Pacific Harbors Council of the Boy Scouts in multiparty sale of easements and land in the Scouts' Camp Hahobas site (Mason County) to Washington's Department of Natural Resources, the Great Peninsula Conservancy, the Trust for Public Lands, and the United States Navy. (2019)

Acquisition of Tilt49 office tower

Represented purchaser of approximately 300,000 square feet of office space in condominiumized mixed-use development project in Seattle. (2017)

Healthcare facilities development

Assisting various clients with the siting, acquisition, permitting, and development of psychiatric evaluation and treatment (E&T) centers and other medical facilities throughout Washington, including successful defense of challenges to local land use approvals. (Ongoing) 

Hotel development

Assisting various clients with the siting, acquisition, permitting, development, and disposition of hotel projects in Washington and Oregon, including mixed-use high-rise projects in Downtown Seattle and Portland. (Ongoing)
