Our appellate litigators represent clients in high-stakes cases at all levels of review, including the U.S. Supreme Court, state supreme courts, federal courts of appeals, and state appellate courts across the country. We know that effectively litigating cases at the appellate level requires not just an understanding of the facts and law, but also a mastery of the intricacies of appellate procedure. Our attorneys know how appellate judges think and which arguments will be most persuasive to an appellate court.

Overview

A Wealth of Experience Across Multiple Industries
Our lawyers have litigated hundreds of appeals in courts across the country and combine deep knowledge of appellate practice and procedure with an equally impressive grasp of substantive law. Comprised of a multi-practice team, our appellate group has an in-depth understanding of the industries they serve, including: administrative law, antitrust litigation, banking and financial services litigation, class action litigation, communications law, constitutional law, employment law, energy law, First Amendment law, intellectual property law, and media and entertainment law. They also regularly leverage colleagues across our offices for additional subject matter expertise and have deep industry connections to harness amicus support when appropriate. In this way we consistently achieve top-tier results for our clients.

Appellate Experience and Accomplishments

U.S. Supreme Court
Our lawyers have argued numerous cases before the United States Supreme Court, including important cases addressing the First Amendment, ERISA, immigration law, search and seizure under the Fourth Amendment, the right to counsel under the Sixth Amendment, and discrimination under the Fourteenth Amendment. We also regularly file cert petitions, briefs in opposition, merits briefs, and amicus briefs in the Court—including in virtually all of the Court's First Amendment cases over the last decade.

Federal and State Appellate Courts
We have handled hundreds, if not thousands, of appeals across the nation, including in every federal circuit court of appeals and numerous state appellate and supreme courts. These cases have addressed essentially every area of U.S. law; but we have especially deep expertise in cases involving issues of the First Amendment, administrative law, antitrust law, banking and financial services litigation, class action defense, commercial disputes, communications law, constitutional law, energy law, and intellectual property law.

Trial Expertise
Our appellate attorneys routinely assist trial teams to ensure that critical issues are preserved for appellate review and that the record is crafted with a view toward further judicial review.

Experience as Judicial Clerks and Senior Appellate Litigators in Government
Many attorneys on our team have served as law clerks for federal and state appellate judges, providing invaluable insight for crafting persuasive appellate arguments. Members of the group have also represented the federal government in front-page appellate litigation prior to joining the firm.

Appellate Community Involvement
Our lawyers are members of appellate inns of court, serve on bench/bar committees, teach appellate advocacy, and are regularly asked to assist other appellate advocates in moot courts. This involvement in the appellate community, combined with frequent appearances before appellate court judges, gives our lawyers a deep understanding of what makes for effective appellate advocacy.
